MIDDLETOWN >> A local business owner who also works on contract with the city has turned himself in on an assault charge in an apparent employee dispute. John Moore, 54, of Westfield Street, turned himself in to city police Tuesday afternoon on three misdemeanor charges — disorderly conduct, third-degree assault and third-degree strangulation. Moore owns Fat City Customs at the city-owned Remington Rand building at 180 Johnson St. Moore also works on a city contract through the Office of Planning, Conservation and Development as Remington Rand’s building superintendent. An arraignment report for Moore did not lay out specific allegations, and the criminal clerk of the Middletown Superior Court did not have a file on the charges Friday morning. Police said that Moore turned himself in at police headquarters Tuesday afternoon, posted a $10,000 bond and is scheduled for arraignment on April 16. Mark Balaban, an attorney for Moore, told the Press, “I believe after a brief review of the facts in the case that Mr. Moore will be vindicated.”

Balaban said it was “simply a case of a disgruntled former employee,” and that the case would be better suited to civil court than criminal proceedings. The employee, said Balaban, had been trying to argue his compensation with Moore. “When he wasn’t successful in that regard, he made the claim,” said Balaban. Planning Director William Warner said Moore has been an incomparable asset to the city. “He has been instrumental in turning the place around,” Warner said of Moore and Remington Rand, where Moore has been managing the building for five years. Despite only being contracted to work 20 hours a week, “He’s there all the time, always seeing what’s needed.” Warner said Moore handles daily exigencies throughout the city building, contending with emergency repairs and a finicky sprinkler system. “My opinion of him couldn’t be higher,” said Warner.
